I would like to ask your guidance in this question.

I am going to work with a partner who lives in Finland. She is going to handle most of the advertisement-related work for the site, including signing up for the affiliate programmes and other similar services. Understandably I will need to include her details in the site WHOIS description so that our advertisement partners can verify her relation to my site. What do you think will be the most appropriate FIELD in the WHOIS record where I should place her contact information? Administrative Contact, Technical Contact or Billing Contact?

I believe Administrative is who controls changes to the domain. You definitely need to retain that.

My opinion would be for your associate to be listed under Technical.

I wouldn't alter an ICANN WHOIS record for anyone unless they own or control the domain. Your advertisers don't need WHOIS records to verify the legitimacy of your partner.

There are several other much simpler methods to assure advertisers or investors that your partners are legit, like naming and identifying your associates on a web page devoted to just that. The fact that you are named along with your partner(s) in any contract you issue is certainly proof positive that a business relationship exists.

ICANN records don't really validate much of anything, legally. You'd be better off to retain yourself, the parent company (or individual), as the controlling party of record.

thanks for your answer...i need to clarify here...I will have my partner get herself a paypal account and get herself subscribed to AFFILIATE programmes related to my site....i will then place those affiliate links to my site.....I want to make sure PayPal doesnt suspect me of any illegal activiyies when her link will be placed on my site and her info is NOT in the WHOIS record. Or do you think it can safely avoided by simply placing her contact details on my site ? I live in Russia (paypal doesnt work with ussad)

If I understand you correctly, all you are technically doing is selling space on your site. It is up to each of your "partners" to set up their own PayPal account (or any other kind of account) and do the affiliate footwork themselves in order to collect the fees.

You have nothing to do with the actual fee collection. Your partners can transfer payments to you by any method you agree upon -- from wire transfers to gold bullion if you want. It is just payment for promoting "their" affiliates. No big deal.

PayPal only cares about the ability to back-charge a bank account and return the money to the buyer if the merchant fails to deliver the goods or services. They can't do that with Russian banks because they are not competent enough or fast enough (or solvent enough) to satisfy PayPal.

Your only problem lies in the arrangement you have with your partners and the means you devise to monitor their income, it any. If you trust them, don't worry about it. It is THEIR bank accounts that suffer if there is a dispute with PayPal, not yours.

So I still say leave WHOIS records alone and just publish a page naming your partners to re-assure the affiliates they gather.

I am writing to ask for your opinion on this - I have thought up a plan how to “overcome” the country-specific limitation PayPal imposes on the citizens of Russian Federation. It is not something illegal. In a sense, I am trying to comply with their standards – how I see them – but I need the opinion of the seasoned PayPal users to help me decide on the chances of this scheme actually working out:

1. I am living in the Russian Federation
2. I am planning to make an International portal, which will rely on affiliate commissions paid mostly through PayPal.
3. I have friends in Finland and USA.

My plan is to make the site, upload it, and have those friends of mine get themselves the PayPal accounts to register as AFFILIATES of portal-specific service providers. I will get the affiliate links from them and post them on my site. I will pay them 10 or 20% of the commissions the site generates. Actually, the process will be backwards - they will send me the 80% or 90% of generated commissions once their PayPal account balance (s) reaches some predefined level. I will NOT be going online to see their PayPal account balances (so that my Russian IP is not seen) – they will send me the reports once in every few days. If they screw me I can always delete their link and ask someone else to become the affiliate partner for me.

I do not know the nature of dynamics of PayPal accounts – have seen them closed when the revenue quickly increases. Therefore I need you to help me to FINETUNE this plan. How to better set it up, what kind of account will do better for this and other considerations…..

Do you think that it will be OK to find a new partner and have himself subscribe for teh same affiliate programmes in teh case PayPal closes the account of my first partner. I am not in any way ttrying to sell or buy anything illegal...Just want to make sure PayPal doesnt ban my SITE together with the accounts of my previous partners.
